1. Agreement to Terms

By accessing or using paintwithgunpowder.com (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site. The Site is operated by Paint With Gunpowder LLC, P.O. Box 744, Jackson, WY 83001.

2. Products & Orders

All artwork listed on the Site is subject to availability. Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.

Original artwork: Each original is a one-of-a-kind piece. Due to the nature of the gunpowder burning process, the final result may have slight variations from photographs shown on the Site. These natural variations are inherent to the medium and are not considered defects.

Prints: Limited edition and open edition prints are reproductions of original gunpowder artwork. Colors may vary slightly between screens and the physical print.

3. Shipping

We ship to addresses within the United States and internationally. Original artwork is carefully packaged and insured for transit. Shipping times vary by destination. We are not responsible for delays caused by shipping carriers, customs, or weather.

Risk of loss and title for items pass to you upon delivery to the carrier.

4. Returns & Refunds

Please see our Refund & Return Policy for full details. In summary: all sales are final. Refunds or replacements are only available for items damaged during shipping or prints with manufacturing defects.

5. Intellectual Property

All content on this Site, including artwork, photographs, text, logos, and design elements, is the property of Paint With Gunpowder LLC and is protected by U.S. and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.

Purchasing artwork grants you ownership of the physical piece. It does not transfer copyright, reproduction rights, or licensing rights. You may not reproduce purchased artwork for commercial purposes without written consent.

6. Live Events & Commissions

Event booking inquiries submitted through the Site are requests only and do not constitute a binding agreement. Event terms, pricing, and logistics are finalized via separate written agreement between Paint With Gunpowder LLC and the client.

7. Limitation of Liability

To the fullest extent permitted by law, Paint With Gunpowder LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or purchase of artwork. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

8. Disclaimer

The Site and all content are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Teton County, Wyoming.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to the Site. Continued use of the Site constitutes acceptance of the updated Terms.
